Terms of Service

These Terms of Service govern your use of elatedallas.com and the Elated marketplace and studio services operated by Appture Digital Media, LLC, doing business as Elated Dallas (“Elated,” “we,” “us”). By using the site or creating an account, you agree to these terms.

1. Who can use Elated

You must be at least 18 years old and able to enter a binding contract. Talent accounts are invitation-only. You are responsible for keeping your login secure and for everything done under your account.

2. The marketplace

Elated connects buyers (venues, planners, agencies and other clients) with talent (performers and creators). Unless we say otherwise in writing, Elated is not a party to the performance agreement between a buyer and talent, and does not employ talent.

3. Profiles and content

Talent profiles may be prepared from publicly available information before an invitation is sent. When you claim a profile, you confirm the information is accurate and that you have the rights to the photos, video, audio and text you publish. You grant Elated a license to display that content to operate and promote the marketplace.

4. Bookings and payments

Buyers pay for bookings through the platform. Payments are handled by a third-party payment provider and released under our Booking & Payment Protection Policy. Do not arrange payment for a booking you found on Elated outside the platform.

5. Talent dues

Invited talent may receive a free introductory period. After it ends, membership dues are deducted from payouts for gigs booked through the platform, at the rate confirmed to you in writing. If you do not book during a billing cycle, dues are not charged to your card.

6. Studio services

Photography, video, recording, rental, crew, sound, lighting and website services are quoted in writing. The written quote, including any deposit, cancellation and delivery terms, controls that job.

7. Conduct

Do not post false or misleading information, harass other users, infringe anyone’s rights or use the site for anything unlawful. We may suspend or remove accounts that break these terms.

8. Disclaimers and liability

The site is provided “as is.” To the extent permitted by law, Elated is not liable for indirect or consequential damages, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim.

9. Changes

We may update these terms. The date at the top shows the latest version. Continued use after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the State of Texas.
